Washington County Trial Courts
Indiana trial courts include circuit courts, superior courts, and city or town courts in some places. Washington County Case Allocation
Local Rule LR88-AR01-9, effective January 1, 2026, is the key Washington County trial-court allocation rule. Superior Court receives all pro se civil matters, all juvenile delinquency matters, all guardianships, about half of pro se dissolution cases, about half of protective-order cases, and about half of pro se small claims and eviction cases. Superior Court also receives specified criminal actions involving alcohol, drugs, nonsupport, fraud, forgery, check deception, robbery, burglary, residential entry, conversion, theft, receiving stolen property, resisting law enforcement, and vehicular offenses.
Circuit Court receives all adoptions, mental health matters, CHINS matters, paternity actions, infractions including vehicular infractions, hardship driver's license petitions, estates, mortgage foreclosures, and criminal actions not designated for Superior Court. Shared or balanced categories include civil matters, small claims, evictions, dissolutions, separation actions, red flag matters, and grandparent visitation. This allocation is why a case search should include both Washington County trial courts when the exact court is unknown.

Washington County Court History
Washington County was dedicated by the Indiana legislature in 1814. The county court system reflects Indiana's older circuit-court structure, with the Washington Circuit Court formed under the state constitutional system dividing Indiana into circuits. The county remains rural and centered on Salem for court, clerk, sheriff, prosecutor, public defender, and detention functions.
The Washington County Superior Court was established in 1986, the same year the current detention facility began operating. Local rules have continued to change, including the 2025 Supreme Court order approving amended Washington County rules and the January 1, 2026 allocation updates. Those updates matter for records because a filing that once might have been expected in one court may now be allocated under the new local rule.
